§1General
These terms set out how to use WantPin, available at wantpin.com (the “Service”). The Polish version is binding; this is a translation.
The Service is run by Maciej Czerwonka, Sterkenburg 92, 5653 NH Eindhoven, the Netherlands (the “Operator”). Contact: kontakt@wantpin.com.
Terms used here:
- User: anyone using the Service, with or without an account;
- Account: a User’s personal account;
- Listing: a “looking for” listing describing what a User needs (an item, a service, a job, a worker or other help);
- “I have it!” reply: another User’s reply to a Listing, which opens a chat;
- Content: anything a User posts: Listings, photos, messages, replies, reviews, profile text.
Using the Service is free.
§2Services
The Operator provides the following services by electronic means:
- browsing Listings on the map and list (also without an Account);
- an Account;
- posting, editing, extending and closing Listings;
- “I have it!” replies and chat between Users;
- watching Listings, alerts about new matching Listings and notifications (in the Service, by email, push);
- reviews after a deal;
- the seller panel (leads, reply templates, business card);
- reporting Content that breaks the law or these terms.
Browsing is agreed when you open the Service and ends when you leave it. The Account agreement starts when you create an Account and runs for an indefinite period.
§3Technical requirements and risks
You need an internet-connected device with an up-to-date browser that has JavaScript and cookies enabled, and, for an Account, an active email address or a Google account.
The internet carries the usual risks, such as malware, phishing or fraud in deals. The Operator never asks for your password, card details or payment codes. Keep your software up to date and be careful when dealing with other Users.
§4Account
Adults may create an Account; people aged 16 or over may do so with a parent’s or guardian’s consent. You sign up with a name, email address and password (confirming the email), or with a Google account.
Give true details, keep your password safe and don’t share your Account. One Account per person.
You can close your Account at any time by writing to kontakt@wantpin.com from the address on the Account. We delete it within 14 days.
§5Listings and other Content
A Listing describes what a User is looking for; the Service is not for selling offers. A Listing is visible for 30 days and can be extended. The map shows an approximate location (moved by 0.5–2 km), never an exact address.
You must not post Content that:
- is illegal, including items and services whose trade is banned or restricted (e.g. drugs, weapons and ammunition without the required permits, prescription medicines, alcohol and tobacco, documents, counterfeits, stolen goods, animals from illegal breeding);
- infringes others’ rights, including copyright, personal rights and privacy (e.g. someone else’s personal data);
- is offensive, vulgar, discriminatory or incites hatred or violence;
- is sexual or concerns sexual services;
- is spam, advertising unrelated to the Listing, or an attempt at fraud (e.g. payment links);
- advertises jobs in breach of employment law, including discriminating against candidates;
- is misleading or posted on someone’s behalf without their consent.
You keep the rights to your Content. By posting it you grant the Operator a free, non-exclusive licence to store, display and distribute it in the Service and in materials promoting the Service (e.g. a link preview of a Listing), for as long as it is in the Service.
§6The Service’s role and deals
The Service lets Users get in touch. The Operator is not a party to agreements between Users, does not handle payments and is not responsible for items, services or Users’ conduct. Users agree the terms of a deal (price, pick-up, shipping, payment) themselves.
Meet in public places, check items before paying and never share card details or payment codes. Consumer rights apply in a deal with a User who is a trader, not against the Operator.
§7Reviews
You can review another User only after a deal: when an “I have it!” reply was accepted or the Listing was marked as found. This is how the Service checks that reviews come from people who actually dealt with each other. The Operator does not edit or remove reviews unless they break the law or these terms (then under sections 8 and 9).
§8Reporting illegal content and point of contact
Anyone, also without an Account, can report Content they consider illegal or against these terms: with the “Report” button on a Listing, profile or message, or by email to kontakt@wantpin.com. A report should explain why the Content is illegal, identify it (e.g. a link), give the reporter’s name and email address (not needed for reports of child sexual abuse) and confirm it is made in good faith (Article 16 of the Digital Services Act, DSA).
We handle reports without undue delay, objectively and not arbitrarily. The reporter gets a confirmation and our decision.
The point of contact for Users and for authorities of Member States, the European Commission and the European Board for Digital Services (DSA Articles 11 and 12) is kontakt@wantpin.com. We communicate in Polish and English.
§9Moderation, statements of reasons and appeals
We may remove or hide Content that breaks the law or these terms, and suspend or close the Account of a User who seriously or repeatedly breaks them. Moderation is done by people (the Operator’s moderators). We do not currently use automated tools to decide about Content; if that changes, we will describe them here.
We tell the User about every such decision with a statement of reasons: what was removed or restricted, on what grounds (a law or a term) and how to appeal (DSA Article 17).
You can appeal within 6 months under “Reports and decisions” in your Account menu or by email. Someone other than the person who decided handles the appeal. You may also turn to a certified out-of-court dispute settlement body (DSA Article 21) or the courts.
After a warning, we may temporarily stop handling reports from people who often send manifestly unfounded ones, and suspend accounts that often post manifestly illegal Content (DSA Article 23).
§10Advertising
The Service may show adverts, including ones served by Google (Google AdSense). Adverts are labelled as such. Personalised adverts are shown only with your consent; see the Privacy policy.
§11Complaints
Send complaints about how the Service works to kontakt@wantpin.com, describing the problem. We reply within 14 days. Consumers may also use out-of-court ways of resolving disputes, such as consumer ombudsmen.
§12Liability
The User who posted Content is responsible for it. As a hosting provider, the Operator is not liable for stored Content unless it knows the Content is illegal and fails to act promptly to remove it (DSA Article 6).
We work to keep the Service running, but technical breaks may happen. The Operator may develop and change the Service’s features.
§13Changes and final provisions
We announce changes to these terms in the Service and by email at least 14 days in advance. If you don’t accept them, you can close your Account before they take effect.
Polish law and EU law apply, including Regulation 2022/2065 (DSA). This does not take away rights a consumer has under the law of their country of habitual residence. The Polish version of these terms is binding.
These terms are available free of charge in the Service, in a form you can download, save and print.
